By using the Website you are agreeing to be bound by these Terms and all applicable laws, rules, and regulations.
The terms «Medikout» and «we» mean Ad Tech Promotions, which provides the services defined below via the Website.
Our Privacy Notice describes our collection and use of personal data connected to your Website use.
Entire agreement
These Terms, the Privacy Notice, Cookie Policy, and any applicable clinic agreement, order form, statement of work, pricing schedule, or other written commercial document cumulatively constitute a legally binding agreement between our users — patients, clinics, website visitors, and Medikout, which regulates your use of the Website and our services.
By using the Website, you with this declare and warrant that:
- you have read these Terms, understand their content, and agree to comply with these Terms in full;
- you have the full legal capacity, and the legislation of your country does not restrict you from using the Website;
- you have and will continuously comply with all applicable laws, regulations, and the third parties' rights;
- if you do not agree with these Terms, please do not use the Website.
Services
In brief: On the Website, patients can submit requests and receive responses from relevant Clinics. We connect patients to clinics and help them get in touch with the relevant medical center.
The Website is a platform that provides users with information about medical services and Clinics where such services may be available («Clinics» or «Medical Centers»).
On the Website, we may:
- collect screening answers from users about their medical request;
- allow users to upload photos, scans, or other supporting materials voluntarily;
- allow users to provide contact information, including a WhatsApp number;
- verify contact details by code, where this step is enabled;
- generate and display clinic recommendations based on the information provided by the user;
- use internal tools and criteria to help manage, prioritize, and route inquiries;
- transfer user requests and related information to Clinics, where permitted and necessary for the service;
- make inquiries available to Clinics through technical or operational channels;
- contact users regarding their inquiry through the communication channels provided by the user, subject to applicable law and consent where required.
We do not assign a user to a specific Clinic or doctor as a medical authority. We aim to help users receive responses from relevant independent Clinics based on the information submitted.
We are not a medical services provider ourselves and we are not responsible for the provision of medical care by any Clinic.
WE ARE NOT A LICENSED MEDICAL CARE PROVIDER AND NONE OF OUR SERVICES OR APPLICATIONS IS INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE OR DIAGNOSE, TREAT, OR MANAGE ANY ILLNESS OR MEDICAL CONDITION.
NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN CONNECTION WITH OUR SERVICES. ALWAYS CONSULT WITH YOUR HEALTHCARE PROFESSIONAL IF YOU HAVE ANY QUESTIONS OR CONCERNS ABOUT YOUR HEALTH OR CONDITION OR EXPERIENCE ANY CHANGES IN YOUR CONDITION OR HEALTH STATUS. IF YOU THINK YOU HAVE A MEDICAL EMERGENCY, CALL EMERGENCY SERVICES OR GO TO THE NEAREST OPEN EMERGENCY ROOM IMMEDIATELY.
How we handle inquiries
On the Website, we generate patient inquiries for Clinics. Medikout may use internal tools and criteria to help manage, prioritize, and route inquiries. We may also attach basic patient information and, where applicable and permitted, photos or CT scans submitted by the patient. Such tools do not constitute a medical opinion, diagnosis, prognosis, treatment recommendation, medical eligibility decision, or guarantee of outcome.
Clinic communication
Clinics may receive and manage inquiries through technical or operational channels made available by Medikout. Clinics may then contact the patient and manage the inquiry depending on the outcome of their communication.
Clinics are responsible for their own communication with patients, for the accuracy of their status updates, and for any medical, legal, regulatory, or contractual obligations arising after they receive a lead.
Patient journey
In brief: A patient may come from an advertisement, answer questions on the Website, optionally upload photos, provide contact details, verify the number, and receive a clinic recommendation. In some cases, the patient may skip the contact and verification steps.
A patient may interact with our Website as follows:
- sees an advertisement;
- visits our Website;
- answers questions on the Website;
- uploads photos or scans, if desired;
- leaves contact details, including a WhatsApp number;
- receives a code and enters it on the Website, where this step is enabled;
- receives a clinic recommendation on the Website.
At this stage, we may generate an internal inquiry score based on the information submitted by the user through the Website. This score is used only to help Medikout manage, prioritize, and route inquiries to relevant Clinics. It does not constitute a medical opinion, diagnosis, prognosis, treatment recommendation, medical eligibility decision, or guarantee that any Clinic will contact the user or provide services.
The patient may skip the contact and verification steps in some flows, and the availability of certain functions may depend on the country, device, campaign, or user-selected path.
We may contact the user through WhatsApp, phone, email, SMS, or other communication channels provided by the user in connection with the user's inquiry.
Such service-related communications may include confirming the submitted information, verifying contact details, sharing or following up on clinic recommendations, checking whether a Clinic has contacted the user, assisting with the inquiry process, and sending other updates directly related to the user's request.
Clinic services
In brief: Clinics may connect with us and receive patient inquiries through channels made available by Medikout. Clinics are responsible for managing their own communications with patients.
- Clinics may connect with us through technical or operational channels made available by Medikout.
- We generate inquiries and make them available to Clinics through channels provided by Medikout.
- The Clinic contacts the patient and changes the lead status depending on the result of the conversation and the sales process.
- The Clinic is solely responsible for the content, lawfulness, and method of its communications with the patient, including any medical claims, treatment offers, price disclosures, consent requests, and follow-up communications after receipt of the lead.
Consent and health data
By submitting information through the Website, the user understands that the information may include health-related or other sensitive data, such as answers about the requested treatment, photographs, scans, or other medical context.
The user confirms that any such information is submitted voluntarily and may be shared with relevant Clinics for the purpose of matching, referral, follow-up, and lead handling, where permitted by law and subject to the Privacy Notice and any required consent.
Where required by applicable law, we will ask for explicit consent before collecting, using, or transferring special category data. If a user does not want to provide such data, the user should not upload it and may still use any alternative flow that does not require it, if available.
We apply appropriate technical and organizational safeguards to protect personal data. However, the user understands that no transmission over the internet is completely secure.
Account
Medikout does not currently provide personal user accounts or patient dashboards. Users may submit inquiries through available forms and communication channels. Clinic accounts may be available only to approved Clinic representatives.
Content
All materials on the Website, including text, graphics, information, images, icons, photos, videos, sounds, music, computer code, trademarks, logos, any other materials, and intellectual property rights to such materials (cumulatively — «Content»), are owned by Medikout and/or used with the permission of the respective copyright holder.
The Content is copyrighted under the applicable law and international intellectual property law, which you shall comply with. You can use the Content only with the permission of its author or copyright holder, except as otherwise provided by the Terms and the applicable law. Please note that fees may apply for the right to use the Content.
Content use
You do not gain any rights when you use (share, copy, download) the Content. You agree not to modify or remove any copyright or authorship notices and other metadata from such Content.
Personal use
You must not use the Content for commercial purposes without our prior permission. Medikout grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license, without territorial restrictions within these Terms' validity, to:
- access and view any Content on the Website;
- share the Content by posting on social networks or copying a link to the Website page.
To use such a license, you must comply with these Terms.
Commercial use

Disclaimer of warranties
The Website operates on an «as is» basis. Medikout makes no guarantees or promises regarding the Website and the information provided, other than as expressly stated in these Terms.
We make no guarantees or promises that:
- the Website does not contain viruses and functions smoothly and error-free;
- the Content is accurate, reliable, adequate, or helpful;
- the Website and the Content have commercial suitability, suitability for a specific purpose, and do not breach the intellectual property rights of third parties or other rights;
- the Clinics have disclosed information about their services to us truthfully;
- any Clinic will contact a patient;
- any patient will convert, book, attend, or complete a procedure;
- any internal tool, criterion, or classification used by Medikout will predict actual commercial or medical outcomes.
Limitation of liability
Medikout is not responsible if any content on the Website is inaccurate, unreliable, or incomplete, for typos or errors in the text, and the consequences of your use of the Content or the application of the information received.
We cannot influence the treatment or guarantee the correctness of the medical recommendations provided via the Website. That is why we are not responsible for such treatment or recommendations' consequences, even if they are provided by our coordinators, by the Website, or by Clinics presented on the Website.
Medikout, its founders, directors, partners, employees, contractors, agents, successors, and assigns are not liable for any kind of damages, lost profits, data loss, or damage to reputation associated with the use or inability to use the Website and information received from Medikout, or arising from errors, omissions, outages, defects, or viruses. To the extent permitted by applicable law, you waive the right to commence any action against Medikout for damages and claims as set forth in the preceding sentence. This provision applies even if Medikout has been informed about the possibility of such damages.
The above disclaimer of warranties and limitation of liability apply to the maximum extent permitted by law.
Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, reimburse and protect Medikout, our partners, contractors, and agents from claims, liability, damage, loss, and costs incurred, including fees or costs of legal services and remuneration of professional advisors and other professionals, that arise as a result of:
- your breach of these Terms;
- your use, in particular inappropriate use, of the Website or Content;
- your breach of any laws, rules, regulations, or the third parties' rights.
Clinics also agree to indemnify us for claims arising from their treatment decisions, patient communications, medical services, regulatory violations, or use of leads beyond the scope permitted by the signed agreement.
Payment terms
Medikout may receive commercial compensation from Clinics or partners. Specific commercial terms are governed by separate agreements.
Clinic agreement
Clinics use our services under a separate agreement, commercial contract, or order form. If there is any conflict between these Terms and a signed clinic agreement, the signed clinic agreement will prevail for the clinic relationship to the extent of the conflict.
Unless otherwise agreed in writing, Clinics are not permitted to resell, transfer, or distribute leads to third parties without our prior written consent. Clinics must not use leads for unlawful, misleading, or discriminatory purposes.
Clinics are responsible for their own regulatory compliance, including, where applicable, requirements related to advertising, telemedicine, medical consent, patient communication, and data protection.
Applicable law and jurisdiction
These Terms shall be governed by and interpreted due to the laws of the Dubai International Financial Centre (DIFC), UAE, without prejudice to any consumer rights provided by the laws of your residentship.
If any material or the use of the Website by you does not comply with the laws of your country, the Website is not intended for you, and we ask you not to use it. It is your responsibility to ensure that you know and comply with the laws of your jurisdiction.
You agree that any disputes, conflicts, claims, or disagreements arising directly or indirectly in connection with the Website or these Terms, including, without limitation, those that relate to their validity, interpretation, or application, should be settled by friendly negotiations directly with our team.
If the consensus is impossible by negotiations, the dispute shall be settled exclusively in a court of the UAE (DIFC) under the applicable DIFC Law.
You shall make all claims within one (1) year from the date of their origin unless a longer period is required by applicable law.

By using the Website and providing us with your contact information, you understand and agree that we may send you electronic communications regarding, but not limited to:

- clinic matching and follow-up communication;
- service-related notices;
- promotional offers, news, and other updates, where permitted by law.

Other terms
Medikout is entitled to check if you comply with the Terms during the Website use. In case of violations, we may revoke or suspend your Account and your access to the Website.
If any of these Terms provision is found to be illegal, invalid, or unenforceable, the remaining provisions will remain in effect and enforceable.
We may transfer our rights and obligations under these Terms to third parties, but this will not affect your rights or our obligations under this Agreement.
We reserve the right to change these Terms. If a material change may affect your use of the Website or your rights as a user, we will notify you within reasonable terms before the effective date by posting a message on the Website or sending you an email.
The printed version of the Terms is admissible evidence in court or administrative proceedings that arose based on or in connection with the Website use, to the same extent and under the same conditions as other documents and records created and stored in hard copy.
